Sherlyn Chopra granted protection bail by Supreme Court in Porn Film Racket Case

5 Feb 2022

Actress Sherlyn Chopra has been in the headlines over her involvement in the porn film racket case by the Supreme Court on Friday. A bench of Justices Vineet Saran and Aniruddha Bose issued notice to the Maharashtra government on the appeal filed by Sherlyn against a Bombay high court order rejecting her anticipatory bail plea. While issuing notice, the apex court said that no coercive action should be taken against the petitioner. The bench in its statement said, "Issue notice... In the meanwhile, no coercive action shall be taken against the petitioner". Advocate Sunil Fernandes, appearing for Chopra, submitted that protection has already been given to other accused in the case.Sherlyn Chopra has been arrayed as an accused in the FIR along with actor Poonam Pandey. The actress has been granted a stay on her arrest, similar to earlier orders passed granting protection to Shilpa Shetty's husband Raj Kundra and Poonam Pandey in the same FIR.

California Supreme Court denies Brad Pitts appeal to review custody case with Angelina Jolie

28 Oct 2021

Hollywood star Brad Pitts appeal regarding the ongoing custody case with Angelina Jolie has been denied by the California Supreme Court. In September 2021, attorneys for Pitt petitioned the high court to review the case after judge John Ouderkirk was disqualified, effectively voiding a previous ruling that granted Pitt more time with the former couple's five minor children.According to People tabloid, on October 27, the high court upheld the appellate court's disqualification decision in a ruling, simply stating, Petition and stay denied.A representative for Pitt said that the court's previous decision was based on a technical procedural issue and the Supreme Court's decision not to review that procedural issue does not change the factual evidence which led the trial judge to reach their clear conclusion about what is in the children's best interests. We will continue to do everything that's legally necessary based on the detailed findings of the independent experts. In a statement, Jolie's attorney said that the actress welcomed the decision. Ms. Jolie is focused on her family and pleased that her children's wellbeing will not be guided by unethical behavior, her attorney said.In July 2021, Ouderkirk was disqualified for failure to make mandatory disclosures about other legal proceedings involving Pitt's legal counseling, which might cause an objective person, aware of all of the facts to doubt Ouderkirk's impartiality in the case, the court opinion read.In Pitt's petition, his attorneys argued that disqualifying Ouderkirk effectively upended the constitutionally authorized temporary judging system in California and now throws open the door to disqualification challenges. Jolie's team argued that Ouderkirk, who had been serving as the couple's private judge, could be biased in his rulings considering he had failed to disclose continuing or new cases Pitt's attorneys had hired him to oversee. When Ouderkirk was hired in 2016, both sides listed their business relationships with the judge, and he has been extended twice during their five-year custody battle. At issue, according to the Appellate Court, were additional cases he was later hired to judge, which he didn't disclose to Jolie'sattorneys.Pitt's attorneys claim in the petition that Jolie had been "made aware of Judge Ouderkirk's significant professional history with Pitt's counsel from the very start. However, for the time being the custody arrangement regarding their minor children Pax, 17, Zahara, 16, Shiloh, 15, and twins Vivienne and Knox, 13, now adhere to the November 2018 agreement.

You cannot file petition challenging observations: SC to NCB challenging Rhea Chakrabortys bail

18 Mar 2021

A few days ago, the Narcotics Control Bureau challenged Rhea Chakraborty's bail in the Supreme Court. The actress was granted bail by the Bombay High Court in October last year after spending nearly two months in judicial custody. The Supreme Court on Thursday told the anti-drugs agency that it would have to challenge the Bombay High Court order if it wanted to assail adverse remarks made in the judgment.A bench headed by the Chief Justice of India was considering the petition filed by the Central Government through the Narcotics Control Bureau against the observations made by the Bombay High Court while granting bail to Chakraborty in the NDPS case registered in connection with the death of Sushant Singh Rajput. The SC observed that petitions cannot be challenged against mere observations in a bail order.Solicitor General (SG) Tushar Mehta who was appearing for NCB told the court that the grant of bail has not been challenged. "My worry is that the court has made certain wide ranging observations about NDPS Act, which make the Act unworkable, the SG said. The Court responded by highlighting that the petition does not challenge the bail order but only the observations made in the judgment by the HC. You can only challenge the order. The observations are prima facie, the CJI said. The SG then requested time to amend to the petition. Granting the time, the court has posted the matter to next Monday (March 22).Rhea Chakraborty was sent to judicial custody last year for drug related charges in the death of her actor boyfriend Sushant Singh Rajput. She was granted bail on the condition that she submit a Rs 1 lakh bond and not leave the country without the permission of the court. The High Court while granting bail to Rhea had said that she is not part of a chain of drug dealers and has not forwarded the drugs allegedly procured by her to somebody else to earn monetary and other benefits.

Supreme Court grants interim protection from arrest to Amazon Prime Video India head Aparna Purohit in Tandav row

5 Mar 2021

The Supreme Court on Friday granted interim protection from arrest to Amazon Prime Video head Aparna Purohit in connection with FIRs lodged against her over the web series Tandav which is currently streaming on the platform. This comes days after the Allahabad HC refused to give her an anticipatory bail in the said case. Aparna moved SC challenging the verdict by the Allahabad HC.Petitioner is cooperating in Lucknow FIR and HC has granted protection. She is ready to cooperate in the investigation. It is submitted that petitioner is @amazon India head and concerned with writing and production of web series. Considering the facts, we issue notice and we direct petitioner shall not be arrested in FIR no 14 of 2021 subject to her cooperation, Justice Ashok Bhushan-led bench remarked. The bench also observed that the Centres regulations on social media are mere guidelines and that does not have provision for action against digital platforms. Law has to be framed to put in place a mechanism to control OTT platforms instead of mere guidelines. The new guidelines of the government on regulating OTT platforms like Netflix & Amazon Prime Video has no teeth as there is no provision of prosecution, the bench said.On February 25, the Allahabad HC had denied anticipatory bail to Purohit stating that "the applicant had not been vigilant and has acted irresponsibly making her open to criminal prosecution in permitting streaming of a movie which is against the fundamental rights of the majority of citizens of this country and therefore, her fundamental right of life and liberty cannot be protected by grant of anticipatory bail to her in the exercise of discretionary powers of this court."Amazon Prime Indias original series Tandav landed in controversies ever since its release in January. Multiple cases have been registered against the makers of the show and the platform for hurting sentiments of a particular community through the series.Tandav premiered on Amazon Prime Video on January 15. It stars Saif Ali Khan, Dimple Kapadia, Mohammed Zeeshan Ayyub, Sunil Grover, Tigmanshu Dhulia, Kumud Mishra, among others.
